Acceptance of Terms
This End-User License Agreement ("EULA" or "Terms") is a legal agreement between you ("User", "you", or "your") and NBApps ("we", "us", or "our") for the Daily Horoscope & Numerology mobile application (the "App").
By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not download, install, or use the App.
Acknowledgement
You acknowledge and agree that:
- This EULA is concluded between you and NBApps only, and not with Apple Inc. ("Apple")
- NBApps, not Apple, is solely responsible for the App and its content
- This EULA does not provide for usage rules that conflict with the Apple Media Services Terms and Conditions
- Apple has no obligation to furnish any maintenance and support services with respect to the App
License Grant
Subject to your compliance with these Terms, NBApps grants you a limited, non-exclusive, non-transferable, revocable license to:
- Download, install, and use the App on iOS devices that you own or control
- Access and use the App's features and services for your personal, non-commercial use
License Restrictions
You agree that you will NOT:
- Copy, modify, adapt, translate, or create derivative works of the App
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
- Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices from the App
- Rent, lease, lend, sell, redistribute, or sublicense the App
- Use the App for any commercial purpose or for the benefit of any third party
- Use the App in any way that violates any applicable law or regulation
- Attempt to gain unauthorized access to any portion of the App or its related systems
- Use any automated system or software to extract data from the App
Subscription and Payment
Freemium Model
The App operates on a freemium model with limited features available for free. Access to premium features, including AI-generated horoscope and numerology readings, requires an active paid subscription.
Subscription Terms
All subscriptions are processed and managed through Apple's In-App Purchase system. By subscribing, you agree to Apple's Terms and Conditions for In-App Purchases.
- Subscriptions are billed through your Apple ID account
- Payment will be charged to your Apple ID account upon confirmation of purchase
- Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel your subscriptions by going to your Apple ID account settings
Refunds
All purchases are final and processed through Apple. NBApps does not have access to or control over your payment information or transaction history. If you believe you are entitled to a refund, you must request it directly from Apple according to their refund policy.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be NBApps' sole responsibility.
Content and Intellectual Property
Ownership of the App
The App, including all code, algorithms, designs, graphics, text, and other content (excluding User Content as defined below), is and will remain the exclusive property of NBApps. The App is protected by copyright, trademark, and other intellectual property laws.
Third-Party Technologies
The App utilizes the following third-party technologies:
- Swiss Ephemeris: Professional licensed library for astrological calculations
- Google Gemini AI: AI service for generating personalized readings through Firebase AI
- Firebase Services: Analytics, Crashlytics, App Check, and Firestore
User-Generated Content
Content generated by the App for you, including personalized horoscope and numerology readings ("User Content"), is provided for your personal use. You may:
- Share your readings as images through social media or messaging platforms for personal, non-commercial purposes
- Save and store your readings for your personal reference
You may NOT:
- Use User Content for any commercial purpose without prior written permission from NBApps
- Claim ownership of the algorithms, prompts, or methodologies used to generate User Content
- Resell, redistribute, or sublicense User Content
Intellectual Property Infringement
You acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, NBApps, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
Disclaimer and Limitation of Liability
Entertainment Purposes Only
THE APP IS PROVIDED FOR ENTERTAINMENT AND INFORMATIONAL PURPOSES ONLY. Horoscope and numerology readings are based on astrological and numerological calculations and interpretations, which are not scientifically proven or verified.
No Professional Advice
The App does not provide, and should not be construed as providing:
- Medical, health, or mental health advice, diagnosis, or treatment
- Financial, investment, or legal advice
- Professional counseling or therapy services
- Predictions of future events or outcomes
Always consult with qualified professionals before making any decisions based on information obtained through the App, particularly regarding health, financial, legal, or other important life matters.
User Responsibility and Assumption of Risk
YOU ACKNOWLEDGE AND AGREE THAT:
- You use the App entirely at your own risk and discretion
- You are solely responsible for any decisions or actions you take based on information provided by the App
- NBApps is not responsible for any consequences, losses, damages, or harm resulting from your use of the App or reliance on any content generated by the App
- You will not hold NBApps liable for any actions you take based on readings, interpretations, or information provided by the App
Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Warranties that the App will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy, reliability, or completeness of any content or readings
- Warranties that defects will be corrected
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- NBApps shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- NBApps shall not be liable for any loss of profits, revenue, data, goodwill, or other intangible losses
- NBApps shall not be liable for any damages arising from your use or inability to use the App
- NBApps shall not be liable for any decisions, actions, or consequences resulting from your use of or reliance on the App
- In no event shall NBApps' total liability exceed the amount you paid for the App in the twelve (12) months preceding the claim
No Liability for User Actions
YOU EXPRESSLY AGREE THAT:
- NBApps is not responsible for any actions you take or decisions you make based on the App
- No legal action, lawsuit, or claim of any kind can be brought against NBApps or its officers, directors, employees, or affiliates arising from your use of the App
- You waive any right to seek damages, compensation, or other remedies from NBApps for any harm, loss, or injury resulting from your use of the App
- You release NBApps from all liability related to misuse, misinterpretation, or any adverse consequences arising from the use of the App
Indemnification
You agree to indemnify, defend, and hold harmless NBApps and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of or access to the App
- Your violation of these Terms
- Your violation of any third-party rights
- Any actions or decisions you make based on information from the App
Maintenance and Support
NBApps is solely responsible for providing maintenance and support services for the App as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
NBApps may, but is not obligated to:
- Provide updates, upgrades, or bug fixes for the App
- Respond to support inquiries
- Maintain the availability of the App
NBApps reserves the right to modify, suspend, or discontinue the App or any part thereof at any time without notice or liability to you.
Data and Privacy
Your use of the App is also governed by our Privacy Policy, which can be found at Privacy Policy. By using the App, you consent to the collection, use, and processing of data as described in the Privacy Policy.
You acknowledge and agree that NBApps may collect and use technical data and related information, including but not limited to technical information about your device, system and application software, and peripherals, to facilitate software updates, product support, and other services related to the App.
Termination
Termination by You
You may terminate this EULA at any time by:
- Deleting the App from all your devices
- Canceling your subscription through your Apple ID account settings
- Ceasing all use of the App
Termination by NBApps
NBApps reserves the right to suspend or terminate your access to the App immediately, without prior notice or liability, for any reason, including but not limited to:
- Violation of these Terms
- Fraudulent, abusive, or illegal activity
- Attempts to reverse engineer, hack, or compromise the App
- Use of the App in a manner that could harm NBApps, other users, or third parties
Effect of Termination
Upon termination:
- Your license to use the App will immediately cease
- You must delete the App from all devices in your possession or control
- All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability
Third-Party Terms of Agreement
You must comply with applicable third-party terms of agreement when using the App, including:
- Your wireless data service agreement when using the App
- Apple's Media Services Terms and Conditions
- Apple's In-App Purchase terms
- Google's Terms of Service (for Gemini AI services)
- Any other applicable third-party agreements
Third-Party Beneficiary
You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
Export Compliance
You represent and warrant that:
- You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country
- You are not listed on any U.S. Government list of prohibited or restricted parties, including the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List or Entity List
You may not use or otherwise export or re-export the App except as authorized by United States law and the laws of the jurisdiction in which the App was obtained.
Updates and Modifications
App Updates
NBApps may provide updates, upgrades, or new versions of the App from time to time. These updates may be automatically downloaded and installed depending on your device settings. You acknowledge that the App may not function properly if you do not install updates, although you are not required to do so.
Terms Modifications
NBApps reserves the right to modify these Terms at any time. We will notify you of any material changes by:
- Updating the "Last Updated" date at the top of these Terms
- Providing in-app notification of significant changes
- Requiring you to accept the updated Terms before continuing to use the App
Your continued use of the App after any such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the App and delete it from your devices.
Governing Law and Dispute Resolution
Governing Law
These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.
Jurisdiction
You agree that any legal action or proceeding relating to these Terms or the App shall be instituted in the competent courts of France. You consent to the personal jurisdiction of such courts and waive any objection to the laying of venue in such courts.
Waiver of Class Actions
To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
Severability
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provisions shall be deleted without affecting the remaining provisions herein.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and NBApps regarding the App and supersede all prior or contemporaneous understandings and agreements, whether written or oral, regarding the App.
No Waiver
The failure of NBApps to enforce any right or provision of these Terms will not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by NBApps.

By downloading, installing, or using the App, you acknowledge that you have read and understood these Terms and agree to be bound by them. If you do not agree to these Terms, do not use the App.
